Tieto Zásady o ochrane osobných údajov pre web www.skypala.sk (ďalej len „Skypala“)(„my“, „nás“ alebo „náš/naša/naše“) popisuje, ako a prečo môžeme pristupovať, zhromažďovať, uchovávať, používať a/alebo zdieľať (ďalej len „spracovávať“) vaše osobné údaje, keď používate naše služby (ďalej len „Služby“), vrátane prípadov, keď:

  • navštívite našu webovú stránku www.skypala.sk alebo akúkoľvek našu webovú stránku, ktorá odkazuje na tieto Zásady o ochrane osobných údajov (ďalej len „Zásady“)
  • zapojíte sa s nami inými súvisiacimi spôsobmi vrátane predaja, marketingu alebo podujatí


Máte otázky alebo obavy? Prečítanie týchto Zásad vám pomôže porozumieť vašim právam a možnostiam týkajúcich sa ochrany osobných údajov. Vaše informácie spracúvame, aby sme mohli poskytovať, zlepšovať a spravovať naše Služby, komunikovať s vami, v záujme bezpečnosti a predchádzania podvodom a v súlade so zákonom. Nie je však možné zaručiť 100%-nú bezpečnosť žiadneho elektronického prenosu cez internet alebo technológie ukladania informácií, takže nemôžeme sľúbiť ani zaručiť, že hackeri, počítačoví zločinci alebo iné neoprávnené tretie strany nebudú schopné poraziť našu bezpečnosť a nesprávne zhromažďovať, pristupovať, ukradnúť alebo upraviť vaše informácie. 1. AKÉ INFORMÁCIE ZHROMAŽĎUJEME?

Osobné údaje, ktoré nám poskytujete
V skratke: Zhromažďujeme osobné údaje, ktoré nám poskytnete.

Zhromažďujeme osobné údaje, ktoré nám dobrovoľne poskytnete, keď prejavíte záujem získať informácie o nás alebo našich produktoch a Službách, keď sa zúčastňujete aktivít v rámci Služieb alebo inak, keď nás kontaktujete.

Vami poskytnuté osobné údaje. Osobné údaje, ktoré zhromažďujeme, závisia od kontextu vašich interakcií s nami a Službami, vašich rozhodnutí a produktov a funkcií, ktoré používate.

Osobné údaje, ktoré zhromažďujeme, môžu zahŕňať:

  • mená,
  • telefónne čísla,
  • e-mailové adresy,
  • poštové adresy,
  • pracovné pozície


Citlivé informácie. Nespracovávame citlivé informácie.

Všetky osobné údaje, ktoré nám poskytnete, musia byť pravdivé, úplné a presné a musíte nás informovať o akýchkoľvek zmenách týchto osobných údajov.

Automaticky zbierané údaje
V skratke: Niektoré informácie, ako napríklad vaša adresa internetového protokolu (IP) a/alebo vlastnosti prehliadača a zariadenia, sa zhromažďujú automaticky, keď navštívite naše Služby.

Automaticky zhromažďujeme určité informácie, keď navštívite Služby alebo sa pohybujete na tejto webstránke. Tieto informácie neodhaľujú vašu konkrétnu identitu (ako je vaše meno alebo kontaktné informácie), ale môžu zahŕňať informácie o zariadení a používaní, ako je vaša IP adresa, prehliadač a charakteristika zariadenia, operačný systém, jazykové preferencie, sprostredkujúce adresy URL, názov zariadenia, krajina, poloha, informácie o tom, ako a kedy používate naše Služby, a ďalšie technické informácie. Informácie, ktoré zhromažďujeme, zahŕňajú:

  • Údaje súvisiace s prihlásením a používaním (Log and Usage Data). Tieto dáta sú informácie týkajúce sa služieb, diagnostiky, používania a výkonu, ktoré naše servery automaticky zhromažďujú, keď pristupujete k našim Službám alebo ich používate, a ktoré zaznamenávame do protokolových súborov. V závislosti od toho, ako s nami komunikujete, môžu tieto dáta zahŕňať vašu IP adresu, informácie o zariadení, typ prehliadača a nastavenia, a informácie o vašej aktivite v Službách (ako sú dátumové/časové značky (date/time stamps)) spojené s vaším používaním, zobrazené stránky a súbory , vyhľadávania a ďalšie akcie, ktoré vykonávate, napríklad aké funkcie používate), informácie o udalostiach zariadenia (ako je napríklad aktivita systému, chybové hlásenia (niekedy nazývané „výpisy o zlyhaní“(crash dumps)) a nastavenia hardvéru).
  • Údaje o zariadeniach (Device Data). Zhromažďujeme údaje o zariadeniach, ako sú informácie o vašom počítači, telefóne, tablete alebo inom zariadení, ktoré používate na prístup k Službám. V závislosti od použitého zariadenia môžu tieto údaje zariadenia zahŕňať informácie, ako je vaša IP adresa (alebo proxy server), identifikačné čísla zariadenia a aplikácie, poloha, typ prehliadača, model hardvéru, poskytovateľ internetových služieb a/alebo mobilný operátor, operačný systém a informácie o konfigurácii systému.
  • Údaje o polohe. Zhromažďujeme údaje o polohe, ako sú informácie o polohe vášho zariadenia, ktoré môžu byť presné alebo nepresné. Množstvo informácií, ktoré zhromažďujeme, závisí od typu a nastavení zariadenia, ktoré používate na prístup k Službám. Napríklad môžeme použiť GPS a iné technológie na zhromažďovanie geolokačných údajov, ktoré nám povedia vašu aktuálnu polohu (na základe vašej IP adresy). Môžete nám odmietnuť povoliť zhromažďovanie týchto informácií buď odmietnutím prístupu k informáciám, alebo zakázaním nastavenia „Poloha“ na vašom zariadení. Ak sa však rozhodnete odhlásiť, možno nebudete môcť používať určité aspekty Služieb.


Google API
Naše používanie informácií získaných z Google API bude v súlade s Pravidlami pre používateľské údaje služieb Google API Services, vrátane požiadaviek na Obmedzené použitie.

2. AKO SPRACÚVAME VAŠE INFORMÁCIE?
V skratke: Vaše informácie spracúvame, aby sme poskytovali, zlepšovali a spravovali naše Služby, komunikovali s vami, kvôli bezpečnosti a predchádzaniu podvodom a dodržiavali zákony. Vaše údaje môžeme s vaším súhlasom spracovávať aj na iné účely.

Vaše osobné údaje spracúvame z rôznych dôvodov v závislosti od toho, ako komunikujete s našimi službami, vrátane:

  • Dodávať a uľahčovať doručovanie služieb užívateľovi. Vaše údaje môžeme spracovávať, aby sme vám mohli poskytnúť požadovanú službu.
  • Reagovať na otázky používateľov / ponúkať podporu používateľom. Môžeme spracovať vaše informácie, aby sme odpovedali na vaše otázky a vyriešili akékoľvek potenciálne problémy, ktoré by ste mohli mať s požadovanou službou.
  • Posielať vám administratívne informácie. Vaše informácie môžeme spracovávať, aby sme vám mohli posielať podrobnosti o našich produktoch a službách, zmenách našich podmienok a pravidiel a iné podobné informácie.
  • Na plnenie a správu vašich objednávok. Vaše informácie môžeme spracovávať na splnenie a správu vašich objednávok, platieb, vrátení a výmen uskutočnených prostredníctvom Služieb.
  • Požiadať o spätnú väzbu. V prípade potreby môžeme spracovávať vaše informácie, aby sme si vyžiadali spätnú väzbu a kontaktovali vás v súvislosti s používaním našich Služieb.
  • Na ochranu našich Služieb. Vaše informácie môžeme spracovávať ako súčasť nášho úsilia o zachovanie bezpečnosti našich Služieb vrátane monitorovania a prevencie podvodov.
  • Na identifikáciu trendov používania. Môžeme spracovávať informácie o tom, ako používate naše Služby, aby sme lepšie pochopili, ako sa používajú, aby sme ich mohli vylepšiť.

Zachrániť alebo chrániť životne dôležité záujmy jednotlivca. Môžeme spracovať vaše informácie, keď je to potrebné na uloženie alebo ochranu životne dôležitých záujmov jednotlivca, napríklad na predchádzanie škodám.

3. NA AKÉ PRÁVNE ZÁKLADY SA ODVOLÁVAME PRI SPRACOVANÍ VAŠICH INFORMÁCIÍ?

V skratke: Vaše osobné údaje spracúvame len vtedy, keď sa domnievame, že je to nevyhnutné a máme na to platný právny dôvod (t. j. právny základ), aby sme tak urobili podľa platných právnych predpisov, napríklad s vaším súhlasom, aby sme dodržiavali zákony, aby sme vám mohli poskytovať služby  s cieľom uzavrieť alebo plniť naše zmluvné záväzky, chrániť vaše práva alebo plniť naše oprávnené obchodné záujmy.

Všeobecné nariadenie o ochrane údajov (GDPR) a GDPR Spojeného kráľovstva vyžadujú, aby sme vysvetlili platné právne základy, o ktoré sa opierame pri spracúvaní vašich osobných údajov. Preto sa pri spracúvaní vašich osobných údajov môžeme spoliehať na nasledujúce právne základy:

  • Súhlas. Vaše údaje môžeme spracovávať, ak ste nám dali súhlas (eng. consent) na použitie vašich osobných údajov na konkrétny účel. Svoj súhlas môžete kedykoľvek odvolať. Prečítajte si viac o ODVOLANÍ SVOJHO SÚHLASU.
  • Plnenie zmluvy. Vaše osobné údaje môžeme spracovávať, keď sa domnievame, že je to nevyhnutné na splnenie našich zmluvných záväzkov voči vám, vrátane poskytovania našich Služieb, alebo na vašu žiadosť pred uzavretím zmluvy s vami.
  • Oprávnené záujmy. Vaše údaje môžeme spracovávať, ak sa domnievame, že je to primerane potrebné na dosiahnutie našich legitímnych obchodných záujmov a tieto záujmy neprevažujú nad vašimi záujmami a základnými právami a slobodami. Vaše osobné údaje môžeme spracovávať napríklad na niektoré z opísaných účelov, aby sme:
    • Analyzujte, ako sa naše služby používajú, aby sme ich mohli zlepšiť, aby sme zaujali a udržali používateľov
    • Diagnostikovať problémy a/alebo predchádzať podvodným činnostiam
    • Pochopte, ako naši používatelia používajú naše produkty a služby, aby sme mohli zlepšiť používateľskú skúsenosť
  • Zákonné povinnosti. Vaše údaje môžeme spracovávať tam, kde sa domnievame, že je to nevyhnutné na splnenie našich zákonných povinností, ako je napríklad spolupráca s orgánom činným v trestnom konaní alebo regulačným orgánom, uplatňovanie alebo obhajovanie našich zákonných práv alebo zverejnenie vašich údajov ako dôkazu v súdnom spore, v ktorom sme zapojené.
  • Životné záujmy. Vaše informácie môžeme spracovávať tam, kde sa domnievame, že je to potrebné na ochranu vašich životne dôležitých záujmov alebo životne dôležitých záujmov tretej strany, ako sú situácie, ktoré môžu viesť k bezpečnosti akejkoľvek osoby.


4. KEDY A S KÝM ZDIEĽAME VAŠE OSOBNÉ ÚDAJE?
V skratke: Môžeme zdieľať informácie v konkrétnych situáciách opísaných v tejto časti a/alebo s nasledujúcimi tretími stranami.

Predajcovia, konzultanti a poskytovatelia služieb tretích strán. Vaše údaje môžeme zdieľať s predajcami, poskytovateľmi služieb, zmluvnými partnermi alebo zástupcami tretích strán (ďalej len „tretie strany“), ktorí vykonávajú služby pre nás alebo v našom mene a na vykonanie tejto práce vyžadujú prístup k takýmto informáciám. S našimi tretími stranami máme uzatvorené zmluvy, ktoré sú navrhnuté tak, aby pomohli chrániť vaše osobné údaje. To znamená, že s vašimi osobnými údajmi nemôžu nič robiť, pokiaľ im k tomu nedáme pokyn. Taktiež nebudú zdieľať vaše osobné údaje so žiadnou organizáciou okrem nás. Zaväzujú sa tiež chrániť údaje, ktoré uchovávajú v našom mene a uchovávať ich po nami nariadenú dobu.

Tretie strany, s ktorými môžeme zdieľať osobné údaje, sú nasledovné:

  • Služby cloud computing 
    Cloudová platforma Google
  • Zálohovanie a bezpečnosť dát
    Google Drive Backup, UpdraftPlus.com a Wordfence.com
  • Webová a mobilná analytika
    Google Analytics a Google Tag Manager
  • Hosting webových stránok
    WordPress.com, Websupport.sk

Môžeme tiež potrebovať zdieľať vaše osobné údaje v nasledujúcich situáciách:

  • Prevody podnikov. Vaše informácie môžeme zdieľať alebo prenášať v súvislosti s alebo počas rokovaní o akomkoľvek zlúčení, predaji majetku spoločnosti, financovaní alebo akvizícii celého nášho podnikania alebo jeho časti inej spoločnosti.
  • Pridružené spoločnosti. Vaše informácie môžeme zdieľať s našimi pridruženými spoločnosťami, v takom prípade budeme od týchto pridružených spoločností vyžadovať, aby dodržiavali tieto Zásady. Medzi pridružené spoločnosti patrí naša materská spoločnosť a akékoľvek dcérske spoločnosti, partneri spoločného podniku alebo iné spoločnosti, ktoré kontrolujeme alebo ktoré sú s nami pod spoločnou kontrolou.


5. POUŽÍVAME COOKIES A INÉ SLEDOVACIE TECHNOLÓGIE?
V skratke: Na zhromažďovanie a ukladanie našich informácií môžeme používať súbory cookie a iné technológie sledovania.

Môžeme používať súbory cookie a podobné technológie sledovania (ako sú webové beacons a pixely) na zhromažďovanie informácií pri interakcii s našimi Službami. Niektoré  online sledovacie technológie (online tracking) nám pomáhajú udržiavať bezpečnosť našich Služieb, predchádzať zlyhaniam, opravovať chyby, ukladať vaše preferencie a pomáhať so základnými funkciami stránok.

Povoľujeme tiež tretím stranám a poskytovateľom služieb používať online sledovacie technológie v našich Službách na analytiku a reklamu, vrátane pomoci a prehrávania reklám, na prispôsobenie reklám vašim záujmom alebo na odosielanie upozornení na opustené nákupné košíky (v závislosti od vašich komunikačných preferencií). Tretie strany a poskytovatelia služieb používajú svoju technológiu na poskytovanie reklamy na produkty a služby prispôsobené vašim záujmom, ktoré sa môžu objaviť buď v našich Službách alebo na webových stránkach.

Vaše informácie môžeme zdieľať so službou Google Analytics na sledovanie a analytiku používania služieb. Ak sa chcete odhlásiť zo sledovania službou Google Analytics v rámci Služieb, navštívte https://tools.google.com/dlpage/gaoptout. 6. AKO DLHO UCHOVÁVAME VAŠE INFORMÁCIE?
v skratke: Vaše informácie uchovávame tak dlho, ako je potrebné na splnenie účelov uvedených v týchto Zásadách, pokiaľ zákon nevyžaduje inak.

Vaše osobné údaje budeme uchovávať len tak dlho, ako je to nevyhnutné na účely uvedené v tomto oznámení o ochrane osobných údajov, pokiaľ zákon nevyžaduje alebo nepovoľuje dlhšie obdobie uchovávania (napríklad daňové, účtovné alebo iné zákonné požiadavky).

Ak nemáme žiadnu trvalú legitímnu obchodnú potrebu spracúvať vaše osobné údaje, tieto informácie buď vymažeme alebo anonymizujeme, alebo ak to nie je možné (napríklad preto, že vaše osobné údaje boli uložené v archívoch záloh), bezpečne uchovávať vaše osobné údaje a izolovať ich od akéhokoľvek ďalšieho spracovania, kým nie je možné ich vymazanie.

7. AKO CHRÁNIME VAŠE INFORMÁCIE?
v skratke: Naším cieľom je chrániť vaše osobné údaje prostredníctvom systému organizačných a technických bezpečnostných opatrení.

Zaviedli sme vhodné a primerané technické a organizačné bezpečnostné opatrenia určené na ochranu bezpečnosti akýchkoľvek osobných údajov, ktoré spracúvame. Napriek našim bezpečnostným opatreniam a snahám o zabezpečenie vašich informácií však nie je možné zaručiť 100% ochranu žiadneho elektronického prenosu cez internet alebo technológie ukladania informácií, takže nemôžeme sľúbiť ani zaručiť, že hackeri, počítačoví zločinci alebo iné neoprávnené tretie strany nebudú schopný poraziť našu bezpečnosť a nesprávne zhromažďovať, pristupovať, ukradnúť alebo upraviť vaše informácie. Hoci sa budeme snažiť chrániť vaše osobné údaje, prenos osobných údajov do a z našich Služieb je na vaše vlastné riziko. K Službám by ste mali pristupovať iba v zabezpečenom prostredí.

8. ZHROMAŽDUJEME INFORMÁCIE OD NEPLOLENÝCH?
v skratke: Vedome nezhromažďujeme údaje od detí mladších ako 18 rokov ani ich nepredávame.

Vedome nezhromažďujeme, nepožadujeme od detí  a ani ich nepredávame deťom mladším ako 18 rokov, ani takéto osobné údaje vedome nepredávame. Používaním Služieb vyhlasujete, že máte aspoň 18 rokov alebo že ste rodičom alebo opatrovníkom takejto maloletej osoby a súhlasíte s používaním Služieb takouto maloletou osobou. Ak sa dozvieme, že boli zhromaždené osobné údaje od používateľov mladších ako 18 rokov, deaktivujeme účet a prijmeme primerané opatrenia na okamžité vymazanie takýchto údajov z našich záznamov. Ak sa dozviete o akýchkoľvek údajoch, ktoré sme mohli získať od detí mladších ako 18 rokov, kontaktujte nás na privacy@skypala.sk.

9. AKÉ SÚ VAŠE PRÁVA NA OCHRANU SÚKROMIA?
V skratke: V niektorých regiónoch, ako je Európsky hospodársky priestor (EHP), Spojené kráľovstvo (Spojené kráľovstvo) a Švajčiarsko, máte práva, ktoré vám umožňujú lepší prístup a kontrolu nad vašimi osobnými údajmi. Svoj účet môžete kedykoľvek skontrolovať, zmeniť alebo zrušiť v závislosti od krajiny, provincie alebo štátu bydliska.

V niektorých regiónoch (ako EHP, Spojené kráľovstvo a Švajčiarsko) máte určité práva podľa platných zákonov o ochrane údajov. Tieto môžu zahŕňať právo (i) požiadať o prístup a získať kópiu vašich osobných údajov, (ii) požiadať o opravu alebo vymazanie; (iii) obmedziť spracúvanie vašich osobných údajov; (iv) v prípade potreby na prenosnosť údajov; a (v) nepodliehať automatizovanému rozhodovaniu. Za určitých okolností môžete mať tiež právo namietať proti spracovaniu vašich osobných údajov. Takúto požiadavku môžete podať tak, že nás budete kontaktovať prostredníctvom kontaktných údajov uvedených v časti „AKO NÁS MÔŽETE KONTAKTOVAŤ V SÚVISLOSTI S TÝMITO ZÁSADAMI?“ nižšie.

Každú žiadosť zvážime a budeme konať v súlade s platnými zákonmi o ochrane údajov.

UCHOVÁVANIE ZHROMAŽDENÝCH INFORMÁCIÍ:

10. CONTROLS FOR DO-NOT-TRACK FEATURES
